Terms of Service

By creating an account on FYL.CARE, you agree to be bound by these terms of service and all applicable laws and regulations.

If you do not accept these terms, you may not use our services.

We reserve the right to modify these terms at any time. Changes will be communicated by email at least 30 days before they take effect. Continued use of our services after changes constitutes your acceptance of the new terms.

FYL.CARE is a professional practice management platform designed for mental health and psychosocial service professionals.

Core services (100% free):

• Client file management

• Appointment calendar

• Billing and financial tracking

• Secure document storage

• Calendar synchronization

• Email support

Optional transactional services (pay-per-use):

• Online invoice payment by credit card (transaction fees apply)

• Automated information collection forms (per-send fee)

• Other premium features to be added progressively

Important: Core services remain 100% free. Transactional services are OPTIONAL and charged only if you choose to use them.

Eligibility requirements:

• You must be at least 18 years old

• You must be a mental health or psychosocial services professional (or in training)

• You must provide accurate and complete information during registration

Account security:

• You are responsible for maintaining the confidentiality of your password

• You may not share your account with others

• You must notify us immediately of any unauthorized use of your account

• You are responsible for all activities performed under your account

We reserve the right to refuse service, close accounts, or limit access to our platform at our sole discretion.

Pricing model:

Free services:

• All core features are 100% free with no time limitation

• No credit card required to use free services

• No hidden fees

Transactional services (optional):

• Online payment: A percentage will be charged on each online payment transaction (rate displayed before use)

• Automated forms: Fees will apply to each form submission (rate displayed before use)

• Exact rates will be clearly communicated before any use

• Immediate billing upon service use

Refund policy:

• Free services cannot be refunded as they are free

• Transactional fees are charged at the time of sending/transaction and are generally non-refundable

• In case of technical problems on our part preventing service completion, a refund or credit will be granted

• Any refund request must be submitted to appfylcare@gmail.com within 7 days of the transaction

As a professional user, you agree to:

Professional compliance:

• Comply with the rules and code of ethics of your professional order

• Maintain professional secrecy and confidentiality of client files

• Obtain appropriate consent from your clients for platform use

• Retain files according to your profession's requirements and applicable laws

Appropriate use:

• Use the platform only for legal professional purposes

• Not use the platform for illegal or fraudulent activities

• Not attempt to circumvent the platform's security measures

• Not transmit viruses, malware, or other malicious code

• Not use robots, scrapers, or other unauthorized automated means

Content and data:

• You are solely responsible for the content you create and store on the platform

• You warrant that you have the necessary rights to all content you upload

• You agree not to upload illegal, defamatory content or content violating others' rights

FYL.CARE ownership:

• The FYL.CARE platform, its source code, design, features, and content are the exclusive property of FYL.CARE

• Trademarks, logos, and trade names displayed are protected by copyright and trademark laws

• You have no right to reproduce, copy, modify, or distribute our platform without written authorization

Your content:

• You retain all rights to the content you create in FYL.CARE (notes, reports, documents, etc.)

• You grant us a limited license to host, store, and display your content solely for the purpose of providing our services

• We claim no ownership rights to your professional data or that of your clients

• You can export and delete your content at any time

Use of artificial intelligence:

• FYL.CARE may use artificial intelligence technologies to improve the platform and develop new features

• Your client data IS NOT used to train AI models

• If we introduce AI features using your data, we will obtain your explicit consent beforehand

• You can disable AI features at any time if they are offered

FYL.CARE is committed to protecting your data and that of your clients in accordance with applicable laws:

• Bill 25 (Quebec)

• PIPEDA (Personal Information Protection and Electronic Documents Act - Canada)

Key points:

• All data is hosted in Canada

• End-to-end encryption for sensitive data

• We never sell your data to third parties

• You can export and delete your data at any time

• In case of data breach, notification within 72 hours

Service availability:

• FYL.CARE is provided 'AS IS' and 'AS AVAILABLE'

• We strive to maintain maximum availability but do not guarantee 100% uptime

• We may temporarily suspend service for maintenance, updates, or security reasons

• We are not responsible for service interruptions due to factors beyond our control (internet outages, natural disasters, etc.)

Limitation of liability:

• FYL.CARE cannot be held responsible for:

- Data loss due to errors on your part

- Indirect, incidental, or consequential damages

- Loss of revenue, profits, or business opportunities

- Inappropriate use of the platform

• Our total liability to you will not exceed the amounts you have paid for transactional services in the past 3 months

Professional responsibility:

• FYL.CARE is a management tool, NOT a professional advisory service

• You remain entirely responsible for your professional and clinical decisions

• You must maintain your own professional liability insurance

• FYL.CARE does not replace your professional or legal obligations

Termination by you:

• You can close your account at any time from your account settings

• Closure is immediate and free

• Your data will be retained for 30 days to allow recovery in case of accidental closure

• After 30 days, all your data will be permanently deleted (except legal retention obligations)

• We recommend exporting your data before closing your account

Suspension or termination by FYL.CARE:

We reserve the right to suspend or terminate your account in the following cases:

• Violation of these terms of service

• Fraudulent or abusive use of the platform

• Non-payment for transactional services used

• Illegal or professionally unethical activities

• Abusive behavior toward our support team

In case of non-payment:

• Your account will be automatically suspended until resolution

• You must contact us at appfylcare@gmail.com to discuss the situation

• Access to your data will be restored upon payment issue resolution

Notification:

• We will notify you by email at least 7 days before any termination (except for illegal activity)

• You will have the opportunity to export your data before final termination

You agree to indemnify, defend, and hold harmless FYL.CARE, its officers, employees, and partners against any claims, losses, liabilities, damages, or expenses (including reasonable attorney fees) arising from:

• Your use of the platform

• Your violation of these terms of service

• Your violation of any law or third-party rights

• Your content or data

• Your professional practice

This indemnification clause will survive the termination of your account.

FYL.CARE reserves the right to:

• Add, modify, or remove features

• Change the user interface and design

• Introduce new paid features (always optional)

• Improve security and performance

Commitment:

• Core features will always remain free

• Any major changes will be communicated by email

• Paid features will always remain optional

• We will not remove essential features without 90 days' notice

Governing law:

• These terms are governed by the laws of the province of Quebec and the federal laws of Canada applicable in Quebec

• Any question of interpretation will be decided according to Quebec law

Dispute resolution:

• In case of dispute, we first encourage amicable resolution through direct contact at appfylcare@gmail.com

• If no solution is found within 30 days, the dispute may be brought before the competent courts of Quebec

Jurisdiction:

• The courts of the province of Quebec will have exclusive jurisdiction for any dispute arising from these terms

Language:

• The French version of these terms prevails in case of discrepancy with other language versions

Entire agreement:

• These terms, along with our Privacy Policy, constitute the entire agreement between you and FYL.CARE

Severability:

• If any provision of these terms is found invalid or unenforceable, the other provisions will remain in effect

Waiver:

• Failure to exercise a right does not constitute a waiver of that right

Assignment:

• You may not assign these terms without our written consent

• We may assign these terms to any entity as part of a merger, acquisition, or asset sale

Force majeure:

• We will not be held responsible for any failure due to events beyond our reasonable control (natural disasters, wars, internet outages, etc.)
